I see larger problems with the Tasini decision (re rights of authors in the newspaper) than with the microfilms. US has not a database protection like the EU (and I am in doubt if a microfilm set is a database) and according Bridgeman v. Corel there is no copyright in the microfilm. If the right holder has still all rights and given consent the microfilm company must accept if someone digitizes their films.
